Personal Injury:

Giles specialises in all areas of Personal Injury for both Claimant and Defendant. This includes employer’s liability, public liability, road traffic, occupiers’ liability, industrial disease litigation, criminal injuries compensation and product liability. Giles has developed a particular niche practice in animal related claims under the Animals Act 1971. In recent years he has regularly appeared in the Court of Appeal in precedent making cases in this difficult subject.



Clinical and Professional Negligence

Giles is regularly instructed in all areas of clinical negligence work. He also acts for Claimants and Defendants in other areas of professional negligence, particularly veterinary claims.



Commercial/ Property:

Giles has extensive experience of contractual claims (particularly relating to sale of goods, supply of goods and services, construction and carriage of goods). He has a particular interest in disputes relating to the sale of livestock and has acted for Claimants and Defendants in cases involving racehorses, show jumpers and other high value livestock. He also undertakes cases involving trusts of land, insolvency and landlord and tenant.



Disciplinary:

Giles regularly advises and represents clients in disciplinary proceedings under British Eventing, BSJA and FEI rules.

Horth v Thompson [2010] EWHC 1674 (QB) Giles acted for the successful Respondent in a case dealing with the aportionment of costs in a Personal Injury claim.



Whippey v Jones [2009] EWCA Civ 452.Case concerning foreseeabilty of harm in a dog attack. Giles acted for the Defendant and successful Appellant in the Court of Appeal.



Freeman v Higher Park Farm [2008] EWCA Civ 1185.Case concerning interpretation of s2(2) Animals Act.



Clark v Bowlt [2006] EWCA Civ 978 [2006] ALLER (D) 1295 (Jun). Interpretation of Section 2 (2) of the Animals Act.

 

Atkins v Ealing London Borough Council [2006] EWHC 2595 (QB) [2006] ALLER (D) 186 (Oct) Scope of Local Authorities duty under Highways Act 1980.

Interests

Having ridden at international level as a young rider Giles retains an interest in Show Jumping and continues to ride, albeit less successfully.
