Tom became a tenant at 9 Gough Square in October 2009 after successfully completing 12 months' pupillage in chambers. His practice is rapidly developing. He is currently instructed (as sole counsel) in a complex multi track property dispute, an appeal by way of case stated against an anti-social behaviour order, and Youth Court proceedings relating to a child sex offence.
Civil
Tom regularly advises and appears in the County Courts in a range of civil disputes. He has experience acting in proceedings in the High Court, the Coroners Court and the First Tier Tribunal - Criminal Injuries Compensation.
His experience in the Employment Tribunal includes cases involving misconduct, retirement and redundancy unfair dismissals, constructive dismissal and discrimination. In Moghal v Hudda [2008] All ER (D) 109 (Sep), Tom successfully appealed a constructive dismissal case in the Employment Appeal Tribunal, before going on to obtain judgment for the claimant at the remitted 3-day hearing before the Tribunal.
Tom's main first six pupil supervisor was Mark Whalan, a very experienced Personal Injury practitioner.
Criminal and related work
Tom regularly prosecutes and defends in the Magistrates Courts, and has experience appearing in the Crown Court as well. He is a CPS graded prosecutor. Rosina Cottage (a Grade 4 prosecutor) and Tom Little (a Grade 3 prosecutor and member of the Criminal Procedure Rule Committee) were his supervisors during pupillage.
In November 2009 Tom defended a 16 year old boy during a 5-day multiple defendant ASBO hearing: London Borough of Bromley v W. He is currently conducting the appeal in this case, and recently obtained an order from the Administrative Court that the Bromley Justices amend the case they had stated for the opinion of the High Court.
Family
Tom undertakes work in a range of family cases. His experience includes acting in care proceedings (for parents and local authorities), applications for non-molestation orders and private law children cases.
Experience prior to joining chambers
In 2007/8 Tom was a Judicial Assistant in the Court of Appeal to Arden LJ and Sir Anthony Clarke MR. Prior to joining chambers he also gained experience acting in a number of cases through the Free Representation Unit (including Moghal,above). He has previously travelled and worked in Australia and Kazakhstan.
