Personal Injury

Principally employers' liability claims for both accidents and disease (including asbestos disease, noise induced hearing loss, HAVS, RSI/WRULD and stress at work) but also road traffic, highway and product liability claims.

Considerable experience of catastrophic injuries/brain damage, Fatal Accidents Act and industrial disease litigation.

Recommended by Chambers & Partners 2006 as “Category 1 Leading Junior”.

Recommended Leading Personal Injury Junior in Legal 500 2005.

Experience principally in obstetric, orthopaedic and dental claims.

Purdue v Devon Fire and Rescue Service  [2002] EWCA Civ 1538 (RTA). Court of Appeal. Ruling on primary liability and contributory negligence in a collision case involving an emergency vehicle travelling through a red traffic light.

Pirrelli plc v Gaca  [2004] 1 WLR 2683 [2004] PIQR Q49 (Employers Liability: Accident) Court of Appeal. Ruling on the deduction (from damages) of payments received by a Claimant from a policy of insurance paid for by the Defendant/Employer.

Edmonds v Lloyds Bank plc  [2004] EWCA Civ 1526 (Employers Liability: Accident) Court of Appeal. Ruling on an issue of failure to mitigate loss (refusal to undergo treatment).

Godbold v Mahmood  [2005] Lloyd’s Rep Med 379  [2006] PIQR Q5 (RTA) Mitting J
Serious brain injury claim. Substantial "Sowden" issue resolved in the Claimant’s favour. One of the first rulings on a Periodical  Payments order.

Harris v BRB (Residuary) & EWS Railway Ltd [2006] PIQR P10 (Employers Liability: industrial deafness) Court of Appeal. Noise induced hearing loss claim by a train driver.

Interests

Married and lives in London with an  energetic and seemingly tireless young family with a general interest in sport, being a now (long!) retired rugby player, a struggling golfer and an all seasons surfer!
