Drawing on these strengths the barristers in our Court of Protection Team provide a unique perspective to issues relating to the welfare and decision making for those that are incapable of doing so themselves: most notably those disabled and of reduced mental capacity arising out of injury and clinical negligence.

The work that Chambers undertakes includes:

  • section 21A applications under the Deprivation of Liberty Safeguards (DOLS);
  • issues relating to the appointment of deputies (welfare/financial affairs);
  • personal welfare applications;
  • decisions on complex/interventionist care packages involving deprivation or restriction of liberty;
  • serious medical treatment applications;
  • cases involving conflicts between the High Court and the Court of Protection’s jurisdiction relating to the care of 16/17 year olds;
  • section 21A applications under the Deprivation of Liberty Safeguards (DOLS);
  • emergency applications, for example arising out of a change in care provision to a vulnerable adult;
  • issues relating to the appointment of deputies (welfare/financial affairs).
