Mediation provides a quick, confidential and cost effective way of resolving disputes without trial, allowing the parties to remain in control of the process and to address issues outside the narrow scope of litigation. A trained mediator is appointed by all of the parties to the dispute to help them resolve their dispute in a manner acceptable to them all.
Mediation can be used to settle any kind of dispute. Litigation does not even have to have been started. The more complex a dispute the more appropriate it is for mediation. Mediation can be a way of cutting through the web of issues to find an acceptable outcome that matches the needs of the parties and reflects the litigation risks.
Mediation avoids the uncertainty and stressful nature of a court hearing, is encouraged by the courts and appreciated by clients. Mediation rarely takes longer than a day and, arranged at the right stage in a dispute, will cost much less than proceeding to a court hearing.
At 9 Gough Square we have 3 practising Barristers who are also CEDR accredited mediators.
They have particular experience in personal injury, clinical negligence, professional negligence and commercial disputes. Our mediators can be booked by a call to the clerks, just as if they were being booked as Counsel for a court hearing.
Guidance for the parties on the process and on the documentation to be provided for a mediation is provided by our mediators.
We also have senior practitioners able to provide the parties with a non-binding assessment of the merits of the case to assist them in their own risk assessments and settlement options. The process is fast and effective and provides an expert neutral view of the case before mounting legal costs become an impediment to settlement.
9 Gough Square also offers arbitration services to achieve accelerated dispute resolutions, click here to find out more.
