Off road accidents; The recent ruling in Lewis v Tindale & MIB (2018)

In Lewis v Tindale & MIB (2018) EWHC 2376, Soole J ruled that off road accidents were not covered by the RTA 1988 and so any relevant insurer for the Defendant was not liable under S152 of the Road Traffic Act 1988 and neither was the MIB under the Uninsured Drivers Agreements.

Soole J also ruled that the MIB is an Emanation of the State, is bound by the Motor Insurance Directives and hence is liable for off road accidents up to at least the insurance obligation of £1 million Euros.

The MIB are appealing.
