Crime and regulatory work

Emily’s busy practice includes prosecuting and defending cases of serious violence, drug supply, sex offences and fraud and dishonesty offences.  She successfully prosecuted an identity fraud worth £250,000 at the Central Criminal Court, and also the £million William Hill employee betting fraud.  Defence experience includes successfully arguing autrefois convict before a High Court judge as well as Newton hearings and the issue of fitness to plead.

Emily is particularly interested in developing her fraud and regulatory practice, having been instructed by a range of prosecuting authorities including the Serious Fraud Office, Fraud Prosecution Service, Revenue & Customs, Department of Work & Pensions and the Food Standards Agency.  As second junior to Andrew Baillie QC in the successful SFO prosecution of Michael Bright, Philip Condon and Dennis Lomas, she is now involved in confiscation proceedings relating to R v Bright and others (Independent Insurance Group Ltd). She is currently instructed by RCPO and led by Rosina Cottage in a £4 million cannabis importation conspiracy. Emily has been appointed to the C Panel List of advocates authorised to prosecute for the Attorney General.

General civil and personal injury

Emily represents both Claimants and Defendants in fast-track and multi-track cases in all areas of Personal Injury including employers’ liability, public liability, road traffic and criminal injuries compensation authority cases.  She is regularly instructed on behalf of trade unions and is content to work under conditional fee agreements where appropriate.  She has also attended inquest hearings in the Coroner’s Court, particularly in asbestosis and road traffic accident cases.

Emily is particularly developing her practice representing the police in SOPOs, ASBOs, closure orders and other civil actions, and successfully argued a case stated in the High Court.  She also undertakes general civil work including landlord and tenant disputes and contractual disputes, having appeared regularly in both the County Court and High Court and argued successfully in the Court of Appeal.

Family

Emily is instructed by local authorities in relation to care proceedings, particularly care orders, supervision orders and emergency protection orders in the County Court, PRFD and High Court.  She has also represented parents in both care cases and private cases involving residence and contact disputes, and contested adoption cases.  She has dealt with clients who have difficulties with legal proceedings as a result of mental impairment.  She has been instructed in ancillary relief proceedings, including a successful argument that the other party had covertly and intentionally reduced the assets available for distribution by the court.  She is experienced in dealing with sensitive cases, and acted as amicus curiae to the court, instructed by the Treasury Solicitor, in order to cross-examine a child alleging sexual abuse against an unrepresented family member.

FPS v Adama-Agbo & others: Successful benefit and mortgage fraud prosecution.

Nhiliziyo v Met Police: Successfully defended appeal by way of case stated in the High Court regarding a SOPO.

MHRA v Patel & Kerrs Chemist: Successful prosecution of a pharmacist for online international sales offences.

D4C Plc: Successfully defended company directors charged with auditing offences.

HM Revenue and Customs v King and Hibbart: Prosecuted high value cocaine and cannabis importation – King sentenced to 8 years imprisonment.

Vernon v Butcher: Successful appeal where Court of Appeal issued guidance on law and experts in boundary disputes.

R v Bright and others (Independent Insurance Group Ltd): Second Junior to Andrew Baillie QC in successful SFO prosecution.  Bright sentenced to 7 years, Condon to 3 years, Lomas to 4 years. Confiscation proceedings ongoing.

R v Dennis: Successfully prosecuted a child abuse case at the Old Bailey.

Nottingham County Council v R and H: Iinstructed by the Treasury Solicitor to cross-examine a child alleging sexual abuse.

R v Grundy & others: Ongoing prosecution of a £4 million cannabis importation conspiracy.

R v Aboagye & others: Junior in aggravated burglary trial.

R v Antoine: Successfully prosecuted a £250,000 identity fraud at the Old Bailey.

R v Haynes: Successfully argued autrefois convict in high value amphetamine supply case.

DPP v Saghir: Instructed by the DPP in the High Court in a vote-rigging scandal.
