At 9 Gough Square Counsel are prepared to back their judgement and advice by sharing the Part 36 risk with clients.

This arrangement has been on offer for some time, but now the 9GS standard CFA provides that in all cases where counsel advises rejection of a Part 36 offer, then should the court award less than the offer 9GS counsel will not make any charge after the Part 36 offer is rejected.

Many standard CFAs provide for normal fees to be paid in these circumstances, but 9GS is willing to back up its word with action.
